Lockwood Painting - Our Terms & Conditions Contract

IMPORTANT NOTE:  All Lockwood Painting clients, please take the opportunity to read over our “terms and conditions” completely.  If you have any questions or concerns about these terms and conditions, please feel free to contact our office.  Please remember that if you agree with the estimate we provided, you are also agreeing with these publicly published terms & conditions.  Thanks for your understanding and cooperation in this matter.

    

Work Standard

Our company is a member of the PCA (Painting Contractors Association) and we follows all proper work protocol and craftsmanship per industry standards.

We Supply Paint, Material and Supplies Needed

We agree to furnish the labor, materials, and supplies necessary to perform the services per the terms and conditions. Upon completion of the services, our team will remove all materials, supplies, and other debris.  We will leave behind any partial gallons of paint so touch-up can be done at a later date.

Proof of Required WSIB (Ontario Worker's Safety Insurance Board) Coverage

Please note that if you are hiring painters for a residential construction project, a commercial store or office in the Province of Ontario and or the painter you hire brings people with him/her to help with the job, then you are required to ask for proof of Ontario WSIB coverage - by law.  If you don't ask for it, then you, the client, are liable to pay the WSIB cost plus penalties and interest if you are caught.  Usually during an CRA audit or when a workplace injury has been reported.

Choosing Your Colours

If your colour choices are not presented at the time your estimate was completed, please note that your choice of colour(s) may reflect a change in the cost of original estimate.  Your choice of an off-white colour (BM Simply White or BM Chantilly Lace, for example) or a light colour over a dark colour may require a first coat of a primer and/or multiple coats to properly cover.  Your choice of a vibrant yellow, red or orange may require a first coat of a tinted primer and/or multiple coats to properly cover. Additional steps that need to be taken will add additional costs to your estimate in both labour and materials.

 

Your Painting Estimate and Additional Requests

The estimate we provided is only for the work and materials as indicated. It does not include additional materials and/or additional labour for additional customer requested repairs or painting, nor does it cover any repairs or any work not listed in the quotation provided.   All additional materials and labour will be re-quoted and or billed at our additional hourly rate and must be approved by you, the client, in writing (email or text message is acceptable).  Please note that all our written estimates have an expiry date of no less than 60 days after they were issued.  Thanks for your cooperation.

Smoking or Non-Smoking

Usually we can tell, but if we don’t mention it, please let us know if the rooms you wish to be painted have been exposed to cigarette smoke, fireplace smoke or leaking fumes from an oil furnace. Years of exposure to smoke and fumes can lead to a build up of nicotine, tar, and or creosote stains on the walls, ceilings, doors, trim and baseboards. Extra steps must be taken to ensure that these stains don’t bleed through and damage your newly painted room. These steps and special primers required will definitely affect the cost of an estimate that does not reflect these details.

Painting with Oil Based Products or Paint with Primer Interior Products

Unless otherwise agreed upon, we regularly use only water based or polyurethane based paints, primers and stains for both interior and exterior projects, 99.9% of the time.   Please note, that as of September 2010, under new environmental laws, oil based paints had stopped being manufactured or imported into Canada.  Following that, oil based paints were to be no longer be available for purchase in Canada after 2012.  Today, only oil based primers and oil base semi transparent stains are available for purchase.

Wallpaper and Border Removal

When it comes time to remove wallpaper and borders, nobody really don’t knows how the job is going to turn out until you get right into it.  Sometimes, it can be an easy task, costing a few hundred dollars. Other times, it can be an extremely difficult task, costing thousands of dollars in labour, especially with drywall repairs following the removal process.  Basically, the outcome is unpredictable and therefore difficult for even the most experienced professional to estimate with accuracy.  For this reason, Lockwood Painting will always estimate the removing of wallpaper on a “by the hour” basis.  Thanks for your understanding.  It's best to hope and pray hard for the best results.

Your Pets & Small Children

While we will always strive to keep you, your children and your pets “paint free”, accidents can happen. While painting work is going on in and outside your home, it’s best to try and secure and keep your small children and pets away from the painting action. Please don’t forget to pick up any “doggie pooh” around your yard before any exterior painting work has started. If, by chance our equipment and shoes come in contact with your pet’s “pooh”, you will be billed at our current hourly rate for the cleaning of these items. Thanks for your understanding on this matter.

Preparing a Room for Painting

Unless otherwise agreed upon, please try and remove any artwork, lamps, drapes, blinds, collectibles and area rugs from the rooms that are being painted.  Please empty out any closets that you would like painted.   If you wish to re-hang artwork in the same place on the wall, please leave nails and hooks in place, otherwise we will repair any wall holes that we find before painting.  Please make sure any attached furnishings and electronics (headboards, flat screen tvs, etc.) are unfastened from the walls for easy removal.  If we will be moving furniture and other items for you, please make sure that any delicate collectibles are removed before we arrive.  Additional labour to prepare your room for painting will be billed at our hourly rate. Please consider this your notification regarding this matter.

30 Days to Wash

Please remember that the fresh paint we will apply needs time to properly dry and to cure.  In most cases, please allow a minimum of 30 days before you attempt to scrub and wash any freshly painted surfaces. This applies to exterior surfaces as well as interior surfaces.  Doing so will void any guarantee we offer might offer and any paint manufacturer's warranty.

Wasps - Relating To Exterior Painting

Over the years we have encountered lots of wasps.  If we are doing some exterior painting on your building, prior to our arrival, please search and remove any wasp’s nests that you might find attached to your buildings.  If we have to remove wasp’s nests ourselves, and we have got quite good at it,  removal time will be billed to you at our current hourly rate plus the cost of equipment and materials needed to do the job.  Thanks for your understanding.

Washroom Availability

Please let us know ahead of time if washroom facilities will not be available to us while we are working on your project so we can make alternate arrangements and make adjustments to our estimate to include a portable toilet rental.  The Ontario Ministry of Labour and Ontario Construction Labour Law requires us to make washroom facilities available to our workers while working on any job site.

Bad Weather

Bad weather, especially rain showers and low temperatures, may hamper our progress with your exterior painting project. Rain and water-based paint certainly don’t mix.  If rain is in the weather forecast for your area, with at least a 40% chance of rain, sorry, but we won’t be painting outdoors that day.  We will return as soon as the weather clears up.

Cancellation Fee

At anytime you need to cancel your previously scheduled painting project, please be courteous and give us 48 hours of notice.  Failure to do so will result in a $250.00 cancellation fee, even in absence of a signed contract.  If you have already paid your deposit this fee will be directly taken from it.

Please Provide A Quick Payment. This is very important, please read.

Please arrange to make your payment for the painting services you received immediately upon completion of your project. This applies to all residential painting clients, with no exceptions.   Any painting projects with an estimated cost value, including taxes, above $1000 will require a minimum 50% down payment, paid at the time of booking, with the balance due immediately upon completion of your project.  It is important to remember that your painting project will not be added to our work schedule until we have received your deposit.

 

If payment is not received promptly upon completion of your painting project, you, our client agrees to pay an additional late payment service charge of 1.5% of the invoice total for each day until the balance is paid in full. This will commence immediately one calendar week after the date of the final invoice.  Sorry, no exceptions.  If payment hasn’t been received within 30 days from the date of your final invoice, it is our policy to begin the necessary steps to file and secure a contractors lien against your registered properties (house, cottage, vehicles, etc.) under the Ontario Construction Lien Act.  Sorry, no exceptions.

Third Party Payments

Please note that Lockwood Painting will never enter into any “third party payment” scenarios.  If you hire us, you accept responsibility for payment for our services. We will not enter into any agreement where payment will come at a later date from an insurance company, a property restoration company, a landlord, a government agency, another service company or a family member or friend, etc. No exceptions in this matter, please.

 

 NSF Cheque Policy

If you decide to make your payment with a personal cheque please note that if your cheque is returned to us “Non-Sufficient Funds” we will add an additional $250 service charge to your bill and require any further payment in cash only.  Our additional NSF service charge covers any NSF fees we may incur from our financial institution plus payment for our time to deal with this problem.  Thank you for your understanding in this matter.

Trades - Carpenters, Drywallers, Roofers, Plumbers, Electricians & Painters?

We do not promote ourselves as a “handymen” or a “jack of all trades” service company.  We are a professional architectural coating application company, or "painters" for short.  Brushes and rollers are the tools of our trade. We don’t have the tools to, nor are we insured to carry out any work at your home other than the work related to the house painting industry (inside & outside finishing).   I am not a licensed General Contractor and I am not willing to sub-contract out any other trades such as carpenters, drywallers, plumbers, roofers, electricians, etc., on your behalf. Thank you in advance for your understanding.  If you are looking for a recommendation for other trade contractors, please visit your local home builder & trades association website.

Christmas/Holiday Hours

Lockwood Painting will be halting operations on the last working day before Christmas Eve at 4:00pm and starting again on the first regular working day after the New Years Day holiday at 8:00am. This time off will give our employees some much needed rest and give them some quality time to spend with family and friends. Thanks for your understanding in this matter.
